Preamble:

This site, cortevelada.pt, is the property of Corte Velada, Lda, all rights are owned by this company. Any reproduction, in whole or in part, is subject, obligatorily, to the authorization of the owners. Hypertext links are, however, allowed without specific requests. The fact of passing an order implies full adherence to the conditions of sale and the prices indicated on the website. Corte Velada also undertakes to respect its obligations. These conditions apply exclusively to all orders placed through the site cortevelda.pt online or by telephone.

Prices:

All prices indicated are final price (VAT included, 6% or 23% according to the products delivered in Portugal, with the participation of shipping costs).

Expedition:

Each order will only be shipped after confirmation of your payment by our bank.

Warranty and litigation:

Except for a special agreement, Corte Velada cannot be held responsible for the mortality of the plants delivered, since many factors are beyond our control. In case of dispute, a friendly solution should always be sought.

Protection of personal data:

All data that is entrusted to us has, as sole objective, the treatment of your order and, in no case, will be reused outside our company or distributed to anyone. By virtue of Law No 78-17 of 6 January 1978 on computer data, files and freedoms, we have a right of access, consultation, alteration, rectification or deletion of the information you have given us.

Acceptance of conditions:

The Customer acknowledges having taken note of the general conditions of sale stated on this screen and expressly accepts them without reservation. These general conditions of sale govern the contractual relations between Corte Velada and its Client, accepted, without reservation, by both parties. These general conditions of sale will prevail over all other conditions, appearing in all documents, unless a prior written derogation is expressed.

Products:

The photographs and data sheets or the advice that illustrate the products are not contractual. If there are errors, inaccuracies or omissions in them, Corte Velada will not be found responsible. The rates are indicated with all taxes included - final price (VAT is included is 6% or 23% according to the products delivered in Portugal, for deliveries in Belgium: VAT is 6% or 21% in Spain: the VAT is 4%, 10% or 21%, in the rest of Europe the VAT is 5.5%, 10% or 20%), not counting the participation to the shipping costs. Price fluctuations cannot give rise to indeminisation. If, for example, an order is placed on day 'd', this order will not benefit from the more advantageous prices that were placed on day 'd + 1'.

Prices:

The prices are expressed in euros on www.cortevelada.pt. The prices indicated in the product sheets do not include delivery costs, unless specified. Rates vary by destination country.
The amount indicated in the order confirmation is the definitive amount, with all taxes included, including VAT for France and the EEC countries. It includes the price of products, the costs of maintenance, packaging, preservation of products and delivery costs.

Order:

Automatic registration systems are considered as valid proofs of the nature, content and date of the order. Corte Velada confirms to the client the acceptance of the order for the e-mail that was communicated to him. The sale will only be completed from the date of receipt of your payment. The order may be considered final only after confirmation of the confirmation email sent to the Customer by Corte Velada. In case of dispute, Corte Velada reserves the right not to honour the order in case the Customer cannot provide the confirmation email. Corte Velada reserves the right to cancel any order from a Customer with whom it has had a dispute regarding the payment of an earlier order. Orders can be sent only after receipt of full payment of these orders. Orders are prepared to the extent that inventory conditions can allow. In case a product is temporarily unavailable, Corte Velada proposes to the Client to choose another article of equivalent value or the refund of the missing article. In the event of an error, inaccuracy or omission in the indication of the coordinates of the consignee, Corte Velada cannot be held liable for the impossibility of delivering order to the buyer. Customer must pay shipping charges again if the address you entered on the order form is incorrect or incomplete. If an error is detected by the customer, it must be reported within 24 hours after the order is issued.

Payment:

The amount invoiced to the Customer is the amount Included Charges indicated in the order confirmation sent by mail.

Payment can be made:

A) by transfer::
The Client must make the transfer to the bank numbers indicated on our website, being careful to remember the references of the order. The Customer's order will only be considered effective when our bank credits us. Transfer costs are the sole responsibility of the Customer.

In the case of an incomplete payment, the order is not effective and Corte Velada will inform the Customer. You may choose to complete the payment or be refunded the amount.

In the case of an unidentified payment, Corte Velada will wait until the Client appears. Therefore, it is important for payments by bank transfer or check that the order references are specified.

Corte Velada reserves the right to refuse an order from a Customer with which there is a dispute.

Delivery:

The delivery will be made by mail (CTT) or by carrier if the orders are important or numerous.
Corte Velada decides how the order is delivered.

In the case of delivery by courier (CTT), if the customer is absent on the day of delivery, you have fifteen days to pick up the parcel at the post office (CTT). In addition to this period, the order will be returned to Corte Velada and you must pay the delivery expenses again so that your order can be sent to you.

Corte Velada informs you by e-mail of the date of delivery of your order.
Delivery times are indicative, and any delays do not entitle the buyer to claim an indemnification. However, if the deadlines exceed the deadlines announced, the Customer must inform Corte Velada to carry out a verification with the carrier.

Devolution:

There are no devolutions on all plants.

Litigation:

Corte Velada cannot be held liable for material, immaterial or bodily damages caused by the misuse of marketed products. The same is true of any product changes resulting from manufacturers.
The responsibility of Corte Velada shall in any case be limited to the amount of the order and shall not be called into question by minor errors or omissions that may occur, although all precautions are taken in the presentation of the products. In case of litigation, a friendly solution should always be favored.

Warranty:

The plants are delivered, according to the norms and customs applicable in terms of production.
The seller guarantees to the buyer the supply of a faithful, good and marketable merchandise, taking into account the technical knowledge, from the production period. The future behavior of the delivered product depends on the care given to it by the buyer upon arrival, considering factors that are difficult or impossible to counter or predict, taking into account the variables of the regions, environment, agronomic and atmospheric conditions and cultural operations and techniques.
Thus, the growth of the plants and the results obtained do not depend only on the quality of the products delivered, and the seller can not guarantee their evolution, even though he has offered advice and suggestions. No claim, based on the guarantee of defects not apparent, will be accepted if it does not prove the liability of the seller.
The seller is not responsible in case of failure of the crop. The seller can not be held responsible for failure in the culture.
In no case shall the seller's liability exceed the price of the delivered goods.
In the case of merchandise received in poor condition, the Customer has 48 hours after receiving the product to make himself known. He must justify by means of photographs or a return of the merchandise after an agreement with the Velada Court. If it is really a defective product, Corte Velada agrees to exchange or refund the defective product within 30 days.

Legal information:

It is mandatory to communicate the registered information collected for distance selling, being indispensable for the processing and routing of orders, invoice preparation and warranty contracts.
Incorrect information leads to non-validation of the order. The customer has and can exercise the right of access, modification, rectification and deletion of the data concerning him (article 34 of the law of January 6, 1978).
Corte Velada also undertakes not to communicate, free of charge or with a counterpart, the coordinates of its clients to third parties.
